Philippines: Search for survivors as Army joins rescue efforts

Rescuers scrambled to find survivors in quake-hit central Philippines today but a series of powerful aftershocks hampered their efforts as President Ninoy Aquino appealed for calm, a day after a 6.8 temblor shook the country killing over 40 people.

As many as 1005 aftershocks were recorded by the Philippine Institute of Volcanology and Seismology till afternoon today as rescue workers struggled to find dozens of missing people in the densely-populated region that was shaken yesterday.

Aftershocks and resultant landslides made several mountainous roads impassable in the Negros, the third-largest island in the Philippines.

President Ninoy Aquino appealed to the quake-affected Central Visayas population to remain calm and cooperate with the authorities as they strive to bring normalcy to the areas.

The quake had struck about 70 kilometers from the coastal city of Dumaguete in Negros.
ANC television news said in a report that Vice President Jejomar C Binay was visiting Dumaguete to inspect the damage and rescue efforts.

School suspended classes in the region as local authorities took account of damage to the school buildings and inspected whether they were afe to hold classes.

Philippines Armed Forces and Navy joined the police force in undertaking evacuation, search and rescue operations, an official statement said today.

The Department of Energy was working to restore power back to affected areas, where communication lines also snapped following the powerful quake.

President Aquino ordered activation of government agency response teams to help quake and landslide victims.

Repair of damaged roads and bridges was initiated by authorities as they cleared routes and re-routed operations.

A total of 44 people were confirmed killed in the quake and dozens were reported missing. The worst-hit was the coastal city of Guihulngan which has a population of 100,000 people.

Officials warned that the toll could be much higher as authorities were yet to accomplish a complete estimate of the total damage caused by the quake, as many areas still remained inaccessible and telecommunication was cut off in some areas.

Those killed in the quake included school children as several buildings collapsed and landslides buried homes.

The strong quake had prompted authorities to issue a tsunami warning but it was lifted later in the day.

The earthquake occurred in the ocean at a depth of 46.6 kilometres.

The Philippines is situated in the so-called Ring of Fire, an arc of fault lines circling the Pacific Basin that is prone to frequent earthquakes and volcanic eruptions.

Sahara open to negotiations as far as Pune is concerned

Sahara Group's chief Subroto Roy today said that he is open to negotiations with the BCCI as far as his IPL team Pune Warriors is concerned but made it clear that the group is no longer keen in sponsoring the Indian cricket team.

"If really needed I will not give a second thought," Roy said when asked if he would like to continue with Pune Warriors this IPL season.

"That's the highest priority in my mind. I don't know what will happen in future years also...anything can happen. But this is certain that players should play, secondly Pune people are so excited for the 1st tournament there...it should have been there...it will happen.

"We have to come out with some way or the other...we are very flexible about it and I am sure that when we will sit we will amicably come out with very good solutions that these things should not happen. Right from the beginning I have said my first concern I my team and they have to play this tournament," Roy told 'CNN-IBN'.

Roy's statement comes a day after BCCI president N Srinivasan said that the board is open to dialogue with Sahara and is willing to resolve the contentious issues.

"(My) first concern is that our players this year should not be deprived of playing IPL. I have already requested BCCI to get them in any organisation fast so that they can play in this IPL. I don't want that BCCI and our team should be in problem in any manner. I am sure when we will sit we will come out with good solutions," Roy reiterated.

Asked about a reconciliation with the BCCI, Roy said, "I can't say at this stage. We have to appreciate one thing; we have already announced a huge plan for social work including development of sports which will involve thousand crores of rupees."

One of Sahara's major grievances was the BCCI's refusal to the franchise's request that the price of marquee player Yuvraj Singh -- currently undergoing chemotherapy in US for a malignant lung tumour -- be added to their overall purse for the auction.

"Today minus Yuvraj we don't have one Indian player of the top 12 or 15 and we have to field seven of them. Some teams have 4-5 players. We were deprived of the older teams...last time 16 best players were retained and we had nobody, somehow Yuvraj was with us. Our team wanted (Ravindra) Jadeja but nobody was listening."

On the other teams getting benefits that Pune did not get, he said, "My complaint is 100% there, last year only I had said you should open the auctions because there are two new teams and there should be level playing fields.

"In the interest of the tournament I had told them that if all the teams are properly balanced we will enjoy each and every match. It is good for the tournament. I don't know people are taking it as a war."

Asked if the IPL auction is held again, Roy said, "I would have accepted any such negotiation but I have to think twice...I won't be able to do it probably because I have already announced a huge social work with this money and I cannot come back from my commitment."

Talking about conflict of Interest with Srinivasan, Roy said, "I should not comment on this. But Mr. Srinivasan said that I am very sorry to hear that I want to withdraw. Since he has a team so he said I am away from these decisions or discussions. What I don't understand that he says that he is having a team, he should not involve in these things, but he is the BCCI president also. He has to involve himself.

Roy said he he did not get the respect he deserved from the BCCI.

"Not in one issue but in number of issues they have not given us minimum respect that we deserve.

Talking further about reconciliation with the board, he said, "Even the sponsorship, if you talk about 10 years back it was a bit difficult but now cricket is very rich and there are many people who are interested to be as a sponsor...so I don't think there is any problem. But I have promised them I am not going to walk out till they get the right sponsors."

On glamour of the IPL having limited value than social work, he said, "Cricket sponsorship and the IPL is much more glamorous from the brand image point of view. No comparison.

IPL is a very good investment. The decision of pulling out of IPL was not an overnight decision. I had informed the decision of withdrawing almost a month in advance.

Constable injured as pistol goes off accidentally

A 26 year-old police constable suffered a bullet injury when his pistol went off while he was cleaning it here today, police said.

The bullet which got embedded in the constable's forearm was removed in a surgery at a private hospital where he was rushed after the incident, police said.

CBI intensifies its probe in 2G allocation during NDA regime

The CBI has intensified its probe in 2G spectrum allocation during the NDA regime when late Pramod Mahajan was the telecom minister and asked the Department of Telecom (DoT) to provide license agreements with all telecom providers between 2001 and 2007.

The DoT, in response to CBI's plea, provided the license agreements that the department had with Bharti Telenet Limited for Delhi service, Aircel for Delhi and Mumbai.

However, files pertaining to DoT's agreement with Hutchison and Streling Cellular (now know as Vodafone-Essar Mobile service), BPL and Idea could not be traced immediately and efforts were on to locate them, official sources said today.

In a letter to CBI's Dy SP R A Yadav, an under secretary in the DoT , said "efforts are underway to locate the remaining license agreements as requested and the same would be furnished shortly."

After booking former Telecom Ministers A Raja and Dayanidhi Maran in two separate cases, CBI in November last year had registered a case against former Telecom Secretary Shyamal Ghosh, the then Deputy Director General (Value Added Services) J R Gupta and two Telecom service providers Airtel and Vodafone for alleged irregularities in grant of additional spectrum.

In its FIR, the CBI had alleged there was a loss of Rs 508 crore to the state exchequer during 2001-07.

"The then Minister for Telecom and Communication (Pramod Mahajan) has been excluded since he expired," CBI had said in a statement but accused him of being a part of criminal conspiracy to allocate the additional spectrum in a "hurried" manner. Mahajan of the BJP was the Telecom Minister during 2001-03. UPA-I came to power in 2004.

The case against Ghosh, Gupta, Bharti Cellular (now known as Bharti Airtel), Hutchinson Max and Sterling Cellular (now known as Vodafone Essar) was registered under 120-B (criminal conspiracy) and various sections of Prevention of Corruption Act, according to CBI. Gupta retired as Director, Bharat Sanchar Nigam Limited.

Both Bharti Airtel and Vodafone have said they had always maintained the highest standard of corporate governance and regulatory compliance.

The CBI alleged in its FIR that Department of Telecom had increased the base spectrum for telecom companies from 4.4 MhZ to 6.2 MhZ during Mahajan's tenure from 2001 to 2003 and also allocated extra spectrum on subscriber-based criteria.

In the FIR, CBI said a case has been registered against the then Telecom Secretary, the then DDG (VAS); three Private Cellular Companies, and others for alleged irregularities in the grant of additional 2G Spectrum and causing a Loss of Rs 508 Crore approximately during the period 2001-2007.

It was alleged that the then Secretary (Telecom) and the then DDG (VAS), Department of Telecom, entered into a criminal conspiracy with three beneficiary private companies, based in Delhi and Mumbai, and abused their official positions as public servants.

"The public servants, with approval of the then Minister of Telecom (Communications and IT) (since expired), took an alleged hurried decision on 31.01.2002 to allocate additional spectrum beyond 6.2 MHz in violation of the report of a Technical Committee," the agency alleged.

Citing the Supreme Court's recent observation, Jammu and Kashmir Chief Minister Omar Abdullah, who has been pitching for partial revocation of Armed Force Special Powers Act (AFSPA) in the state, today said the statute was not aimed at protecting acts of crime.

"AFSPA is for legitimate protection and not for protection of the acts of crime. And that is something we have always maintained," Omar told reporters here.

The Chief Minister, who was reviewing restoration work at the erstwhile Dogra power centre - Mubarak Mandi heritage complex in Jammu, said, "AFSPA protection is given to the personnel so that they not become victims of the law while rendering their (anti-militancy operational) duties."

Omar said, "I do not think the armed forces have to commit rape, murder or any other such activities in order to perform their duties.

"Therefore the observation of the Supreme Court is correct."

Questioning the extent to which the army can claim blanket immunity under AFSPA, the Supreme Court had said rape and murder committed by its personnel should be considered a "normal crime", and that there is "no question of sanction" from the government before prosecution of offenders in such cases.

Under AFSPA, prior approval is required before prosecution or any other legal action can be initiated against armed forces personnel operating in areas declared "disturbed" by the government.

"You go to a place in exercise of AFSPA, you commit rape, you commit murder, then where is the question of sanction? It is a normal crime which needs to be prosecuted, and that is our stand," an apex court bench of justices B S Chauhan and Swatanter Kumar had remarked.

The court said AFSPA gave "very limited protection" confined to action in "discharge of duty".

The court was hearing the CBI challenge against the army's invocation of AFSPA against prosecution of eight officers chargesheeted in the Pathribal fake encounter in March 2000.

While the five men were identified as Lashkar-e-Toiba mercenaries by the army, they had turned out to be locals from nearby villages of Brariangan, Halan and Anantnag.

Devas hired US lobbyist to manage ISRO deal

Devas Multimedia, whose satellite communications contract with the Indian government-owned Antrix was scrapped after a controversy, has been lobbying here to push forward its case before the US President and other lawmakers and has paid USD 140,000 so far for the same.

As per the disclosure reports filed with the US Senate, lobbyist firm Hogan Lovells US LLP began lobbying on behalf of Bangalore-based Devas Multimedia before the American lawmakers in June 2011.

Hogan Lovells said in its latest quarterly disclosure report that it was paid USD 60,000 during the fourth quarter of 2011 (October-December period) for lobbying on behalf of Devas.

Prior to this, Hogan Lovells had earned USD 60,000 in the third quarter and another USD 20,000 in the second quarter of 2011 as lobbying-related income from Devas, its disclosure filings with the US Senate showed.
Hogan Lovells has been registered as a lobbyist of Devas Multimedia in the US since June 6, 2011.

Queries regarding to the disclosure sent to Devas remained unanswered.

As per the disclosure reports, Devas has been identified as a 'satellite communications and technology company'.

Without naming Antrix, the lobbyist firm has said that the lobbying issues for its client Devas Multimedia include "foreign direct investment and government procurement issues relating to a satellite communications contract in India."

Hogan Lovells has further said that it was lobbying for Devas' case before the US Senate, the Department of State and the Executive Office of the President.

While the specific reasons for lobbying in the US could not be ascertained, Devas Multimedia on its website lists entities like German telecom giant Deutsche Telekom AG, private equity firm Columbia Capital LLC and Telecom Ventures as its shareholders.

The company describes itself as "an Indian company headquartered in Bangalore" and says it was founded in 2004 by a team of successful satellite entrepreneurs and executives.

The company says its integrated satellite system ensures seamless connectivity throughout India and it aims to "deliver advanced Internet-based multimedia and interactive data services to hand-held mobile terminals via a unique IP-based platform."

A controversy had erupted years after the signing of the deal in January 2005, under which Antrix was accused of giving Devas an unrestricted access to the high-frequency S-based spectrum, known to be highly valuable for mobile broadband services, from two satellites at very low valuation.

The deal was annulled by the government in February 2011 and two separate committees were set up to probe any irregularities in the matter.

Devas says it entered into a definitive agreement for Space Segment Lease in January 2005 with Antrix for a dedicated portion of leased transponder capacity on GSAT-6 and GSAT-6A for its integrated satellite network.

A High Level Team (HLT), chaired by former Chief Vigilance Commissioner Pratyush Sinha, has recommended investigation into the functioning and operations of Devas since its inception, when it had a share capital of Rs 1 lakh with two shareholders.

As per the findings of the HLT, the agreement with Antrix was signed in January 2005 and by December 31 that year, the ordinary share capital had increased to over Rs 5 lakh with 12 shareholders.

"As on March 31, 2010, Devas had 17 shareholders with Deutsche Telecom (holding 20 per cent), the two Mauritius based entities (holding 17 per cent each) and Dr M G Chandrasekhar, another ex-ISRO scientist (holding 19 per cent) being the largest ones together holding over 73 per cent of the ordinary share capital, the HLT said.

The HLT said that such a high premium of Rs 578 crore earned from foreign investors was unusual and could have been only because of the Antrix deal, for an internet service provider like Devas with an initial share capital of Rs 1 lakh, no asset base, no IPR or patent in the relevant technology, and making losses since inception.

"Changes in the shareholding pattern of Devas have led to two Mauritius-based entities holding 34 per cent and foreign entities holding over 54 per cent of Devas' ordinary share capital as on March 31, 2010," it further said.

"... In order to get a clear picture of the changing pattern of ownership of Devas, the economic interest of various individuals in Devas and the extent to which the increase in share value has been encashed by individuals, the shareholding pattern of the company and of the Mauritius-based entities needs to be looked into by an appropriate investigative agency", the HLT said.

GDP growth projection of 6.9 pc for FY'12 disappointing:Pranab

Describing the 6.9 per cent growth projected for the current fiscal as disappointing, Finance Minister Pranab Mukherjee today said it was on account of a slowdown in industrial output and investment growth.

"Though figures of advance estimates for GDP for the current fiscal somewhat look disappointing by our recent growth experience, considering the current global context and the slowdown in the domestic industrial sector in particular, the growth performance is not all that surprising," Mukherjee said in a statement.

Earlier in the day, the Advanced Estimates released by the Central Statistical Organisation (CSO) said the economic growth is likely to fall to 6.9 per cent in 2011-12.

The GDP would slow to a three-year low, against 8.4 per cent expansion in the last fiscal.
Mukherjee said although investor sentiments have improved in recent months, it is still an area of concern. Besides the government is also working towards fiscal consolidation and controlling inflation.

"We shall have to give more focus on both reaching higher growth trajectory and at the same time to keep in mind that the inflation should continue to be in moderate range," he told reporters here.

He said the main reason for decline in the GDP growth is slowdown in industrial growth, in particular in investment growth, but exuded confidence that the growth figures could be revised upwards when the full data for year 2011-12 becomes available.

"No doubt these are challenging tasks, but national and international environment has thrust upon challenges. We shall have to face these challenges collectively," he said.

Mukherjee said there have been some encouraging signs in the recent weeks on business sentiments, Rupee exchange rate, moderation in headline inflation, possibility of a bumper Rabi crop and continued strong performance of the service sector.
These factors, he said, "should help in recovering the growth momentum".

As per today's data, manufacturing growth is expected to drop down to 3.9 per cent in this fiscal from 7.6 per cent last year.

The CSO's GDP growth projection is a tad lower than the 7 per cent forecast made by the Reserve Bank of India in its quarterly monetary policy review last month.

In its mid-year Economic Review, the government had pegged growth at around 7.5 per cent. The current estimate is sharply lower than the 9 per cent growth projection for 2011-12 made by the government in its pre-Budget survey in February last year.

The latest GDP growth estimate of 6.9 per cent for the entire fiscal means the pace of economic expansion slowed in the second half of 2011-12, given that GDP growth in the April-September, 2011, period stood at 7.3 per cent.

Pop sensation Lady Gaga is launching her own social networking website exclusively for her fans.

Gaga, 25, has used online forums to boost her worldwide appeal and has become the first celebrity to register 18 million followers on Twitter, Daily Star reported.

Now the 'Poker Face' hitmaker is putting her technology skills to use by founding her very own networking site for her devotees, who she lovingly calls "little monsters".

The site, called littlemonsters.com, is currently being set up and the webpage invites fans to register with their email address.

The site has been set up with the help of social media start-up company Backplane, in which Gaga is an investor.

Nasheed held world's first underwater cabinet meeting

Maldives 44-year-old President Mohamed Nasheed, who quit Tuesday, hit the global headlines three years ago when he held a cabinet meeting under water to highlight global warming and the threat to his atoll nation.

In an innovative move aimed at grabbing attention, Nasheed and his ministers were in full scuba gear as they met for about 30 minutes at a depth of six metres just north of the capital Male in 2009.

Nasheed was the first democratically elected president in the history of the Maldives, said the president's official website presidencymaldives.gov.mv.

He was elected president Oct 28, 2008, defeating incumbent president Maumoon Abdul Gayoom, who ruled the Maldives from 1978-2008.

Nasheed graduated from Liverpool University in 1989 with a Bachelor of Arts in Maritime Studies.

In 1990, Nasheed helped establish Sangu, a political magazine that scrutinised the ruling political class. The government banned Sangu within a year of its first publication and Nasheed was arrested and jailed.

In 2003, Nasheed fled the Maldives. A year later, on Nov 10, 2004, he co-founded the country's first opposition party, the Maldivian Democratic Party, in exile in Sri Lanka.

After spending 18 months in self-imposed exile, Nasheed returned to the Maldives April 30, 2005 to establish the MDP in the Maldives, defying a government edict banning political parties.
