Insufficient laws to tackle terror-funding: FATFNew Delhi: A global task force which tracks money laundering and terrorist financing across national borders, has raised doubts about the efficacy of India’s laws in combating this dual menace. The multi-national Financial Action Task Force (FATF) is an inter-governmental organisation founded in 1989 by the G-7 (Group of seven industrialized nations) to develop policies to combat money laundering and terrorist financing. FATF, which admitted India as its the 34th member in June this year, has in its report identified fund transfers from foreign non-profit organisations (NPOs), counterfeiting of currency, drug trafficking and extortion as “major sources for terrorist financing” in the country. “India does not maintain a unified database for NPOs... statistics on the number of registered NPOs under the various statutes are not generally available in India. However, by government estimates, there are approximately two million foreign and domestic NPOs operating in India. “India has not yet undertaken a review of its NPO sector, as envisaged by the FATF standards. There has been no effective outreach to the NPO sector by the Government of India or by state governments in relation to risks and vulnerabilities of the sector to terrorist financing abuse,” the report says. In a scathing indictment of the effectiveness of the Indian laws to monitor and counter terror funds and money laundering, the report said, “except under the Income Tax Act and the Foreign Contribution (Regulation) Act, the NPO sector is subject to limited or no monitoring and supervision, but the NPOs registered under these Acts only account for a small number of entities within the sector.” The FATF also expressed doubts about the effectiveness of laws like the Narcotic Drugs and Psychotropic Substances Act (NDPS) in existence since 2001 and the Prevention of Money Laundering Act, in force from 2005 in the country but there being a “total absence” of any money laundering convictions in these cases till date. “In addition, given India’s vulnerability to terrorism and the large number of actual terrorist attacks per year, the number of terrorist related Suspicious Transaction Reports (STRs) also appears to be extremely low, raising further questions about the implementation and effectiveness of the STR reporting obligation,” the report added. Banks and financial institutions submit STRs to the finance ministry’s Financial Intelligence Unit (FIU) which forwards to other investigative agencies all reports suspected to involve terror funding and money laundering. Source: Business - Google News | 18 Jul 2010 | 2:53 am Sebi for simpler IPO formsMumbai: As part of efforts to attract more retail investors to the stock market, regulator Sebi is considering making applications forms simpler and shorter for public offers, including IPOs. Concerned over the lukewarm and ever-falling retail response to the primary market, Sebi is mulling over ways to win over small investors in this segment and one of the steps under consideration is a simpler investment process. According to sources, the application forms currently being used for bidding in initial and follow-on public offers are unnecessarily long and ask the investors to fill in some details that can be done away with. Besides, these forms run into 15-20 pages in most cases, although there are only 2-3 pages where particulars need to be filled in by the investors and the rest of the pages contain instructions, information about the company and the issue and details about bankers, registrars and bidding centres. The various proposals currently being discussed by Sebi’s Primary Market Advisory Committee include removing from these forms the details already available in the investors’ demat and bank accounts. These include the name of the investor’s father or husband (depending on whether the investor is male or female), addresses, fax number and other contact details. The move could cut down the columns needed to be filled by almost half, sources said. Besides regulation and development of the primary market, this committee also advises Sebi on changes required to make the systems and procedures simpler and transparent. To make the forms shorter and simpler, the committee is also considering dividing them into two parts -- one comprising the particulars needed to be filled in and the other with the details of the issue. Sources said that a proposal is also underway to make it mandatory in all public offers to give the investors the option to bid online, possibly through the stock exchanges themselves, where the forms could be much simpler and shorter. Sebi has already asked the bourses to make a simpler form available online for IPO bidding through the ASBA (Applications Supported by Blocked Amount) process. Under ASBA, bid money remains in the investor’s bank account during the bidding process and get released after share allotment. However, not all investors are required to bid through ASBA. Besides, this facility is not available for all issues and with all banks. Some changes can be expected on this front also, as Sebi is looking to expand the ASBA service further. The primary market used to be retail investors’ favourite investment avenue and an entry point for many of them till a few years ago, but their interest has been dwindling of late. This was reflected even in the recent offers from some public-sector firms, which have traditionally enjoyed a sound and safe investment image among public investors. The MDG Summit is being seen as a turning point in the collective effort to achieve the goals by the 2015 target date. The major states where Kharif crops are vulnerable are Uttar Pradesh, Madhya Pradesh, Gujarat, West Bengal, Karnataka and eastern Rajasthan. These states are major Kharif crops growing regions. Kharif crops like bajra, rice, urad, arhar, groundnuts, soyabean, castor, sugarcane, cotton and jute are sown with the onset of the southwest monsoon in June. The report quoting Indian Meteorological Department said that the country received rainfall of 254.5 mm against a normal of 292.5 mm, indicating a deficiency of 13% from 1 June to 14 July. It, however, said though there has been increase in vulnerability numbers, they seem to be quite low compared to that in initial weeks of the season last year and the overall situation does not look worrisome as it was last year. The deficiency in rainfall was 27% in the same time last year. The percentage of crop vulnerability for bajra in Rajasthan was 8%, while it was 8.5% in Uttar Pradesh and 5.1% in Gujarat on 14 July. For maize it was 4% in Karnataka, Bihar (2.3%), Uttar Pradesh (4.4%) and Madhya Pradesh (2.4%). Likewise for rice it was 5.4% in West Bengal and 8.4% in Uttar Pradesh. The percentage of vulnerability number for ragi was 15.9% in Karnataka, while for urad it was 12.2% in Uttar Pradesh, for arhar it was 8.4% in Uttar Pradesh, for groundnuts it was 17.3% in Gujarat, for sunflower it was 1.1% in Uttar Pradesh and for soyabean it was 17.9% in Madhya Pradesh. The report predicts better times in the coming week. Quoting the IMD it said the coming week is likely to experience a widespread rainfall activity over the northeastern states, sub-Himalayan West Bengal and Sikkim and northern Bihar, eastern Uttar Pradesh during first half of the week. Also a fairly widespread rainfall activity is likely to continue over the West Coast and south Gujarat during the first half of the week, it said adding there is a dim possibility of formation of low pressure system over the Bay of Bengal. CEO Steve Jobs apologized Friday to people who are less than satisfied with the iPhone 4, even as he denied it has an antenna problem that needs fixing. “We’re not perfect,” Jobs said at a news conference. “Phones aren’t perfect.” The more than 3 million people who have already bought an iPhone 4 can go to Apple’s website starting late next week and sign up for a free case, he said. Apple can’t make enough of its $29 “Bumper” cases for everyone, so the company will let people chose from several case styles. New buyers through 30 September will also be eligible. Apple will send refunds to people who already bought a Bumper. Jobs, expressing irritation with the critical coverage of the phone’s reception problems, echoed an earlier statement from Apple that no cell phone gets perfect reception. He played a video showing competing phones, including a BlackBerry from Research in Motion Ltd., losing signal strength when held in certain ways. He talked for 45 minutes and took 45 minutes of questions with Apple’s chief operating officer, Tim Cook, and Bob Mansfield, a senior Apple executive in charge of hardware engineering. Countering Jobs criticism of Blackberry’s signal strength, Mike Lazaridis, president and co-chief executive officer, RIM and Jim Balsillie, co-chief executive officer, RIM said: “Apple’s attempt to draw RIM into Apple’s self-made debacle is unacceptable. Apple’s claims about RIM products appear to be deliberate attempts to distort the public’s understanding of an antenna design issue and to deflect attention from Apple’s difficult situation. RIM is a global leader in antenna design and has been successfully designing industry-leading wireless data products with efficient and effective radio performance for over 20 years. “During that time, RIM has avoided designs like the one Apple used in the iPhone 4 and instead has used innovative designs, which reduce the risk for dropped calls, especially in areas of lower coverage. One thing is for certain, RIM’s customers don’t need to use a case for their BlackBerry smartphone to maintain proper connectivity. Apple clearly made certain design decisions and it should take responsibility for these decisions rather than trying to draw RIM and others into a situation that relates specifically to Apple.” Phones usually have an antenna inside the body. In designing the iPhone 4, Apple took a gamble on a new design, using parts of the phone’s outer casing as the antenna. That saved space inside the tightly packed body of the phone, but meant that covering a spot on the lower left edge blocked the wireless signal. Consumer Reports magazine said covering the spot with a case or even a piece of duct tape alleviates the problem. It refused to give the iPhone 4 its “recommended” stamp of approval for that reason, and on Monday it urged Apple to compensate buyers and fix the problem. The company had been criticized about spotty iPhone service in the US on AT&T Inc.’s network even before the newest model came out. On Friday, in the company’s first remarks following the magazine’s report, Jobs said Apple was “stunned and upset and embarrassed.” Jobs said the iPhone 4’s antenna issue isn’t widespread, with just over five out of every 1,000 complaining to Apple’s warranty service and less than 2% returning the device. Jobs also said that while the iPhone 4 is dropping calls slightly more frequently than its predecessor, the iPhone 3GS, it’s “less than one additional dropped call per 100.” “We’re not feeling right now that we have a giant problem we need to fix,” Jobs said. “This has been blown so out of proportion that it’s incredible.” Analysts have criticized Apple’s responses to reports of reception problems as dismissive, and cautioned that the company shouldn’t come across as arrogant. A curt note attributed to Jobs told one early iPhone buyer to either hold the phone a different way or buy a case. Apple has also said the main problem is actually with software, not antenna design. Apple said it recently discovered that iPhones display more cell phone signal “bars” than they should, leaving people who believed they had a strong signal frustrated by dropped calls. Apple issued a software update Thursday that it said would make the number of bars shown on the phone’s face more accurate. But Consumer Reports painted the problem as much broader. On Friday, the magazine said the free cases were “a good first step toward Apple identifying and finding a solution for the signal-loss problem of the iPhone 4.” No phone owner wants a gadget that doesn’t work. But many people who have bought an iPhone 4 or are considering one seem willing to forgive the antenna problem because they like its other features so much. “It’s not really my concern because I hardly make calls,” said Ross Beck, a 22-year-old student in Seattle. “Honestly, it doesn’t faze me. I know Apple and I know they fix their mistakes.” Helen Ferszt walked out of Apple’s flagship store in New York City on Thursday after ordering the iPhone 4, her third model, despite having heard of the reception problems. “I love the iPhone,” said the 78-year-old psychotherapist from New York. But she added that Apple needs to do better than giving away a free case. “No, I want it to be fixed,” she said. “They can’t just hang us out to dry.” Jobs apologized Friday to buyers who had less-than-perfect experiences with the new device. “We’re going to do whatever it takes to make them happy and if we can’t make them happy we’re going to give them a full refund and say we’re really sorry we inconvenienced you, and we’re going to do better next time,” he said. The refund applies even for those who have long-term contracts with AT&T Inc., the iPhone’s exclusive US wireless carrier. Apple shares slipped $1.55, less than 1%, to close Friday at $249.90.
