Elena Kagan Doesn’t Get Aroused by 2 Live Crew

The new question that all potential Supreme Court justices are judged on (Does 2 Live Crew turn them on?) has been answered for Elena Kagan. The answer's no. We know this because in 1990 Kagan wrote an amicus brief for the RIAA that argued that the the Crew's 1989 album As Nasty As They Wanna Be is not obscene:

Nasty does not physically excite anyone who hears it, much less arouse a shameful and morbid sexual response.

That's right, it doesn't excite anyone. Not a single solitary person has been aroused by this album. That doesn't mean she's not a fan, though. She also wrote that the album has "serious artistic value." So there you have it.

Kagan's RIAA brief revealed: 'As Nasty As They Wanna Be' fails to 'physically excite,' 'arouse' [Copyrights and Campaigns via Newser]

Long Movie Titles: What’s Up With That?

The Times goes all Andy Rooney on us today in a story about movie titles that are just too damn long. With nostalgia for the days of Speed, Armageddon, and Twister, the Times lists some upcoming movies that take just as long to type as they'll take to see, including Prince of Persia: The Sands of Time, Cats & Dogs: The Revenge of Kitty Galore, and The Twilight Saga: Eclipse. But long movie titles aren't just a hassle to those people who have put them on marquees, they may also be bad for the bottom line.

“The more a title describes the story, the less effective it generally is,” said Dennis Rice, a marketing consultant who has held top positions at Miramax, United Artists and Disney. “You want people to know what they’re getting. But you also want to leave them wanting to learn more.”

Then there's the issue of saying the name of the film during commercials. If simply identifying the thing takes up twenty seconds, that only leaves ten seconds to get the audience excited. That's what the Times says, at least.

We're not so sure they're giving movie titles a fair shake. Sure they've found a lot of long ones, but out this weekend are movies like MacGruber and Holy Rollers. In fact, there are more one-word movie titles (Centurion, Takers, Killers, Twelve, Predators, Inception, Salt, Beastly, Marmaduke, Splice, Ondine, Cyrus) out this summer than absurdly long ones. But which of these is worse? We're not sure. Someone ask Andy Rooney.

Glenn Beck Is No Fan of Weiner

Anthony Weiner continued his needling of the Tea Party this week when he put out a report blasting the gold dealer Goldline for preying "on the public's fears of inflation and socialist takeovers." The report didn't sit well with Glenn Beck, who endorses Goldline and is an all-around gold fanboy. Beck accused Weiner of trying to shut down his show and going all Joseph McCarthy on him. But more hilarious, Beck launched WeinerFacts.com, a website dedicated to all things Weiner. The Observer spoke with the Weiner himself about the site.

"He's attacking the messenger and not addressing the message," said Mr. Weiner, who said he had seen the site on Wednesday but hadn't looked at it since. "I think ultimately Fox News and his radio station and he are going to have to answer the questions about this advertiser and about their role in promoting them."

"The focus of my report was not primarily [Mr. Beck's] show. I haven't called for him to be shut down, I haven't called for him to be sanctioned. He's got to live with himself," Mr. Weiner said. "I don't know where the McCarthy charge comes from. I'm not trying to do anything more than protect his viewers from him."

Meanwhile, WeinerFacts.com is producing some horrible but amusing Photoshops of Weiner and wieners.

One More Art Theft and We’ve Got a Trend

Thieves in Marseilles stole a Picasso lithograph and four paintings from a collector this week, French officials said today. According to the police, the two crooks managed to get past two security gates and knock on the door of the collector's home. When he answered, they beat him up and stole his art. This theft comes just a few days after works by Picasso, Matisse, Braque, Modigliani, and Fernand Leger were stolen from Paris's Museum of Modern Art after thieves outsmarted its security system. Seems like it's time for Broadview Security to head to France. [AP]

Andrew Cuomo Makes It Official: He’s Running for Governor

He's in! Attorney General Andrew Cuomo finally announced that he's running for governor this morning in a video released on his website. In the 21-minute video (eesh) he rails against the current state of New York politics, which he calls "upside down and backwards" and a "national disgrace." Then he outlines his "New New York Agenda," which includes things like ethics reform in Albany and fixing the state's fiscal problems. But because a web video is only sorta official, he'll make the announcement official-official this afternoon with a press conference in Lower Manhattan.

What We’re Really Not Talking About When We Talk About Elena Kagan

As the questions over Elena Kagan’s sexuality — the short hair, the cigar smoking, the softball playing — finally die down, what’s depressing is not that we indulged in this conjecture, it’s that we’re indulging in it yet again. Donna Shalala, Janet Reno, Condoleezza Rice, Janet Napolitano, Sonia Sotomayor ... didn’t this same speculation swirl around these women, too, at some point or another? Is there not a pattern here?

Some of these women probably are gay. And some, one can fairly assume, are not. But what’s interesting — and depressingly clear — is that a disproportionate number of women who’ve made it to the tippy-top of the executive and judicial branches in the last three administrations have shared a similar profile: unmarried, outspoken, partial to pantsuits, and child-free. Which would seem to suggest a few things, right? Like, No. 1, that it’s these women who survive the vetting process. And, No. 2, that something about being unmarried, outspoken, partial to pantsuits, and child-free has made it possible for them to get to the top in Washington ... or that getting to the top in Washington, at least for this generation of ceiling-crackers, has resulted in being single, outspoken, partial to pantsuits, and child-free.

First, the vetting. This can more or less be explained in four words: Zoe Baird, Kimba Wood. These two women were, respectively, Bill Clinton’s first and second choices for attorney general, and both were undone by their failure to pay their nannies’ Social Security taxes. When Clinton finally selected Janet Reno, who had neither a husband nor children, he unwittingly alighted on a formula for the ideal female nominee. The less complex her personal life, the less apt she is to have nanny problems or high-powered spouses with conflicts of interest or dubious ties (cf Geraldine Ferraro).

But second — and far more poignant — the less complex a woman’s personal life, the more apt she is to have poured her considerable energies into her professional life. Remember that offhand comment Ed Rendell, the governor of Pennsylvania, made about Janet Napolitano when she was nominated to run the Department of Homeland Security? "Janet’s perfect for that job. Because for that job, you have to have no life. Janet has no family. Perfect. She can devote, literally, nineteen, twenty hours a day to it." Or how about the endless, tedious fuss that was made over Condi’s slip of the tongue, when she accidentally referred to W. as her husband? (Or, for that matter, the enduring image of her waking at 4:30 every morning to get in her 40 minutes of cardio.)

Whether being single and without children is the cause or the effect of so much hard work is hard to say (though we do know that until recently, the more education a woman had the less likely she was to marry, and it’s still true that never-married women are more likely than married women to outearn men). But regardless of how these formidable women got there — whether it was by default or by design — Kagan, Rice, Reno, et al. all serve as painful reminders that women without families may have an easier time of it, still, when it comes to getting ahead. And that’s the dirty, undiscussed truth here. It’s not whether these women are gay.
