It'd be cool if the relative quiet on Walker's orientation was because America recognized that Judge Walker's sex life doesn't affect his job. (Minimal MSM and right-wing pickup so far.) As SF Weekly points out, even calling the Chronicle's article an "outing" is misleading: Walker has never tried to hide his orientation, and it's pretty common for judges to keep their personal lives away from the spotlight, in the interest of perceived impartiality.

But I tend to think a slightly funnier explanation for the relative quiet—that the right-wing bullies who usually drive a story like this forward simply don't read the San Francisco Chronicle or gay blogs like Queerty, which has been reporting this story for months—is at play. Recall that six months ago right-wingers feared Sonia Sotomayor incapable of fairly judging white men. When it comes to minority judges, plenty of people are still idiots. Hard-right hangouts like The Corner are just warming up so the wingnut freak-out machine still has time.

The most cynical guess would be that the right measured the risks and calculated that luck of the draw (which is how the Prop. 8 trial landed in Walker's courtroom) is still in their favor. Here's why:

  • A Republican appointment, Walker is believed to lean conservative, albeit by way of libertarianism, which could make him gay-friendlier.
  • Almost everyone agrees that, after 21 years on the bench, Walker is fair. There is no reason to believe he'd change now—if anything, the Gay Olympics debacle demonstrated an imperviousness to public pressure. (And resisting the urge to scream But I am one in Nancy Pelosi's face was probably hard.)
  • If he rules against Prop. 8, the homophobes will have their big, nasty appeal primed and ready.
It goes without saying that Judge Walker's sexuality is irrelevant. Assuming gay judges always side with other gays (or "Wise Latinas" with other Latinas) is a flawed logic that assumes neutrality lies with heterosexuals (or whites, or males). The rabbit hole of identity-based speculation is infinite (What if Judge Walker is self-hating? What if he overcompensates? What if one of the lawyers looks like his ex-boyfriend who was such a jerk, and he can't judge fairly because he just hates that guy's face so much?) and pointless. As Queerty elegantly states, "Immutable characteristics do not disqualify a person from exercising justice."

Also, if you write a law that so offends an entire class of people that you cannot trust them ever to discuss it fairly, then perhaps there is something wrong with your law.

The Cove has some beef with Japan. The documentary slams the international dolphin trade based there. Now, a Japanese distributor has made the controversial move of putting out the dolphin-loving film in the country which is cool with killing dolphins. [TheWrap]

24 is becoming a movie, finally. Billy Ray (State of Play, Flightplan) will write the script. Kiefer Sutherland will of course star in the film, which sends Jack Bauer to Europe. All this is complicated by the fact that the show's run on Fox could be ending this year. And the fact that torturing terrorists in the name of democracy has fallen out of fashion. [Variety]

A team of sociologists at the University of Pennsylvania undertook an exhaustive study of the New York Times most-emailed list. They first assembled a data set based on the contents of the list over more than six months. Then they dug in to see why stories ended up there. Thus they unlocked the secret of journalism's holy grail—and perhaps even of virality itself.

Their findings, as reported by the Times' John Tierney, are a mix of the totally obvious and the Slate-y counter-intuitive. The obvious: A prominently-featured article is more likely to make the list, as is one written by a famous person. Slightly more surprising is the fact that longer articles were more e-mail-worthy.

But the most fascinating findings are also the most useful for anyone hoping to make it on the only list that matters, journalism-wise. Using complicated math, researchers identified four qualities of an article which resonate with the 'email-this' part of readers' brains. Most-emailed articles are:

  • Awe-inspiring: Being 'awe-inspiring' was the quality which most improved an item's odds of making the list. These articles blow readers' minds by dealing with something physically or intellectually enormous—a natural wonder, a work of art, a big idea, the indomitable human spirit, etc. People like to share awe-inspiring New York Times articles at lunch so they can forget their own puniness long enough to finish the workday. (Example articles: "Fury of Girl's Fists Lifts Up North Korean Refugee" and "The Promise and Power of RNA.")

  • Emotional: If you want to convince a reader to hit the 'email this article' button, try tugging on their heart-strings with a weepy tale of struggle or redemption. Soon, their offspring will be deleting yet another email from Mom with the subject "You HAVE to read this article. SO SAD!". (Example: "Redefining Depression as Mere Sadness.")

  • Positive:"If it bleeds it leads"—the old newspaperman's cliche—did not hold up under our researchers' critical gaze. People like to share happy things, apparently. (Example: "Wide-Eyed New Arrivals Falling in Love With the City")

  • Surprising: Unsurprisingly, people like to share articles that are surprising. Think, things that make you go "woah." (i.e. a story about chickens in Harlem, or a marathon-running restaurateur.)

    Using these four variables, we have visually dissected the top five most e-mailed Times articles as of 11pm, Feb. 9th, 2010. Study them, for they hold the secret of Internet immortality:


    1. America is not Yet Lost
    2. Sinatra Song Often Strikes Deadly Chord
    2. The New Math on Campus
    4. Have Faith in Love
    5. For Students at Risk, Early College Proves a Draw

Leno: Filming Ad Gave Me Chance to See "Old Friend"


Jay Leno and David Letterman took different tacks Monday night in addressing their much-discussed 15-second Super Bowl ad with Oprah Winfrey. Leno tried to play it cool, making super hip Facebook references and joking with his Jay Leno Show audience that filming the ad with Letterman gave him a chance to see “his old friend again”:

"We all watched together. Letterman and I hadn't seen each other in over 18 years. We lost touch. He found me on Facebook. He made a friend request, I accepted, and we hooked up and watched the game."


Letterman wasn’t quite so jolly on the Late Show: he thanked “the actors who played Oprah and Jay Leno.”

Joe Jackson Calls for 'Interrogation' of Murray


After physician Conrad Murray pleaded not guilty to a charge of involuntary manslaughter earlier today, Joe Jackson appeared on Larry King Live to discuss his son's murder case. While Joe restated that he believes Murray is guilty of murdering Michael, he maintained that he believes "others" were involved in his son’s death, and that “interrogating” Murray is the only way the truth will come out.

"Well, I know that I'm looking for justice for my son. To me, [Murray is] just a fall guy. There's other people, I think, involved with this whole thing, but I think that [if] he's interrogated -- he would come clean and tell everything he knows," Jackson told King.

Serial Cat Killer Avoids Jail

Remember that plot on The Office a while back where Dwight killed Angela’s cat by sticking it in a freezer and it was “funny” because it was just so outlandish? Well, turns out killing your girlfriend's cat in real life can result in bigger problems than just getting a scolding from Steve Carrell.

A 37-year-old alleged “serial cat killer” was let go today after a Manhattan Supreme Court judge signed off on a no-jail plea deal. Sean Lynde had been charged with murdering five of his ex-girlfriend’s cats from October 2008 to January 2009 while they were living in her West Side apartment.

Lynde, who now lives in Maine, must stay away from his ex and her one still-living pet, a dog named Sasha (apparently Lynde’s cool with canines), and he must attend weekly psychotherapy sessions for a year, per the terms of the deal. Lynde admitted as part of the plea to killing one of the cats (Bonafide, a 2-month old male) and to harassing his ex online (he posted a picture of her on Craigslist in an ad soliciting sex).

Manhattan Supreme Court Justice Michael Obus said he only supported the deal because Lynde’s ex was “fully on board,” as she apparently did not want to have to testify about her “heartbreak” in court. Bloomberg Among 2009's Top Philanthropists


New York City Mayor Michael Bloomberg gave away $254 million of his estimated $17.5 billion fortune to philanthropic causes last year, earning him the #4 spot on the list of Americans who gave the most to charity in 2009, according to the Chronicle of Philanthropy. Though The Hurt Locker has been gaining some ground on Golden Globe winner Avatar with recent PGA and DGA wins, TorrentFreak’s list of last week's top ten most pirated films reveals Avatar has a firm grasp on the top spot as the most-pirated film, with The Hurt Locker trailing at #4. While there are definitely a lot of questions to ask here (for one thing: who are these people who still haven't seen Avatar?!), perhaps the most puzzling finding is that there are (apparently a lot of) people who actually went through the effort to illegally download Couples Retreat.

First he picks the wrong team to win the Super Bowl, and now this: the President's approval rating has hit a new low, according to a Marist University poll out today.

The poll indicates that while 44 percent of registered voters approve of Obama’s job so far, 47 percent aren’t fans, representing the worst rating the president has received since taking office. The slip is primarily due to a shift among independents; only 29 percent of independents polled said they approve of Obama’s performance, a steep drop from the 53 percent who said they did in April of 2009.

Surprise! Bradley Cooper Won’t Be Romancing Julia Roberts in Valentine’s Day


Just last week, we pondered the question "Why is Warner Bros. trying to hide the fact that Kevin Smith directed Cop Out?" And now, after being barraged with a series of Valentine's Day TV commercials over the weekend, we would like to ask another fairly simple question of the ad wizards in the Warner Bros. marketing department: Why you are burying the fact that America's newly minted stud-muffin, Bradley Cooper, romances Eric "McSteamy" Dane in this movie and not Julia Roberts?

As anyone who has seen the trailer or any of the TV commercials will attest, those devious marketing folks at Warner Bros. highlight a number of photogenic couples romping through tried and true rom-com scenarios in their Valentine's Day ads: Ashton Kutcher proposing to Jessica Alba, Taylor Swift making out with Taylor Lautner, Anne Hathaway smooching Topher Grace, Jamie Foxx making eyes at Jessica Biel, and even Shirley MacLaine batting her eyelids seductively at Hector Elizondo. Following this same logic, all the spots that we have seen feature Bradley Cooper chatting up Julia Roberts in an airplane, leading the audience to think that the two might fall for each other on St. Valentine's Day.

However, it turns out that, in the film, Cooper only has eyes for Eric Dane; the whole Roberts angle that gets so much play in the trailers is just a red herring meant to distract audiences from this coupling of two extremely good-looking dudes. We're not exactly sure why Warner Bros. would bury this in their promotional campaign, unless they were concerned that it might scare potential ticket-buyers into going to see something else at the theaters this weekend. One could float the theory that Cooper's agents and management team insisted on keeping this plot element out of the marketing materials (and therefore not "harming" Cooper's new reputation as a studly, macho, womanizing action star), but considering that this is at least the second time that Cooper has portrayed a gay man on film (the other being Wet Hot American Summer), it seems as if he's comfortable with his sexuality and wouldn't be the type to resort to this sort of deception.

So, we ask you, the loyal Vulture reader, what do you think? If they showed Cooper and Dane kissing or holding hands in the trailer, would it make you more or less likely to go see the film (which, BTW, we hear is tracking very well and will most likely take home the box-office crown this weekend)? You know where to sound off!

Last night’s Superbowl XLIV was watched by a record 106 million viewers, with almost half of those viewers likely being Ladies. Kirsten Gillibrand to Jill Zarin: Fellow Senators ‘Treat Me Like Their Daughter’

Jill Zarin was an honorary speaker at last Saturday's Human Rights Campaign's annual gala, "Speak the Truth," and the very real housewife introduced Senator Kirsten Gillibrand, who of late has become a vocal advocate for pro-LGBT legislation. By the time we approached the reality leading lady (who is no stranger to confrontations among peers), we discovered she'd already done some reporting herself: "[Senator Gillibrand is] beautiful, young, and very personable. And I actually asked her what it's like in Washington with all the old men, because she's so beautiful," Zarin told us. "She said, 'Well, they treat me like their daughter.'" Really, now. We wondered whether Zarin bought that line, considering Gillibrand's stature as a newbie with potentially rocky future prospects. "Yes, but I sadly kind of think it's in more of a condescending way. You really have to earn respect [in Washington], you don't get a free pass walking in, especially because she was appointed, so it's harder for her to fight her way." We have yet to hear back from Gillibrand's press office on the accuracy of Zarin's reporting and political analysis.

Kate Gosselin Took Ten Inches Off Her Hair


At the beginning of January, Kate Gosselin unveiled new long hair on the cover of People. Ted Gibson spent twenty hours — nearly a full day — sewing extensions to Kate's head to rid her of her old reverse mullet. And to think that even after all that work they still looked fake. Kate had to return to Gibson recently because her own hair grew out, rendering her extensions a mess that needed fixing. Gibson says they decided to cut it to make it "sexy and moving." Oh, sure. We think we know what really went on here. Kate went around with chest-length hair for a month, realized she looked like she'd give anything to be back in high school rather than help her kids through it, and decided to take on a more mature style. This just goes to show the consequences of a bad haircut, like Kate's reverse mullet. She has the best people in the world working on her hair and it still shows no matter what she does with it.

I gotta say, as a football fan, I was thrilled to biscuits about last night’s Super Bowl (expression for the new millennium), but as a connoisseur of forced puns, I’m somewhat disappointed with this year’s crop of Super Bowl headlines.

Let’s take a spin through 10 Super Bowl pun/jokey headlines from major publications — they’re mostly decent, but there’s a lot of overlap and nothing that screams “Super Bowl Of Awful Pun Headlines”. No “Winning Is A Brees”, no “MAN-ning, What A Bad Throw”, and not even a “Saints Misbehavin’, By Which We Mean Winning!”

Lady Gaga’s Skeleton Corset Looks a Little Gross When She’s Not Wearing It


Lady Gaga is auctioning her glitter skeleton corset to raise money for Haiti, which is awesome, and may help make up for those rumors that she declined to participate in "We Are the World." Bids on the corset, which is signed and has an estimated value of $2,000, are up to $5,000. Bidding doesn't end until February 23, so who knows how much it will go for? Also, it's interesting to see her clothes separate from her. Like, how uncomfortable and scary they look. Like this piece, which may double as the world's most effective brassiere. But also, the plastic (or rubber?) and straps here look to have been salvaged from the interior of a car — seat belts, dashboard, and all. The scariest part is the plastic diaper that comes attached to the top, which on its own resembles those safety swings babies put their legs through. Yet it looks cool on Gaga. The lesson here for whoever wins the auction: This piece is meant to be worn.

Anne Hathaway Leaves Catholic Church for Gay Brother


Anne Hathaway, who has been a part of the gay-rights movement since even before she co-starred in the landmark film Brokeback Mountain, told British GQ this month that she and her traditionally Catholic family left the Church over its views on homosexuality. Having a gay family member was enough to make them, like many other families, feel unwelcome. "The whole family converted to Episcopalianism after my elder brother came out,” she told the magazine. “Why should I support an organization that has a limited view of my beloved brother?" Though, in all honesty, after Hathaway's ex-boyfriend Raffaello Follieri embroiled the Vatican in a scandal over their seeming involvement in the convicted fraud's phony real-estate scheme, we're not sure the Church was so sad to see her go.

She doesn't think they need to be literally fed, but says, "We need to feed the egos of these girls." She misses the era of supermodels, when Kate Moss, Amber Valetta, and Kristen McMenamy would all walk Versace's runway together. Some designers became scared the personalities of such famous models would overpower and distract from the clothes. But not so, says Donatella: "Fame on fame means more fame!" She adds:

"There is an idea of neutrality in models now. Little make-up, no expression, like a robot ... That is very stupid. It is almost as if the models have to have the appearance of something serious, to give an intellectual base, but they themselves are rarely like that."


She doesn't need her girls to be smart, but she wants fashion to be fun again, and it's a model's job to bring it. Or at least it used to be. The models of yore had balls and would run around acting crazy and fighting with each other. Donatella recalls a scene that played out in front of her brother Gianni:

"One day they had a fight about roots. Kristen [McMenamy] had arrived with black roots in blonde hair, and Linda [Evangelista] arrived with black roots in blonde hair; and both of them went mad, both saying they were first. Really, that is a big thing for models — roots! They were calling the hairdresser in New York, the colourist in New York, and I was called on as a witness to say who was the first to do black roots in blonde hair. At the time Steven Miesel [sic] was really inventing the look of the girls in this way, so I knew who was first: Kristen."


See? She egged them on, instinctively knowing at the time, even if her brother didn't realize it, that fashion would be nothing without catfights and egos.

"The first time they got together, it was the big girls versus the new girl. I remember one time backstage: Linda needed to go on the runway. She was about to put in her fake boobs and found one of them had been taken. 'Where is my boob? Where's my boob?' she was screaming over and over. I think it was Kristen — it was always Kristen. Gianni's reaction? [She mimics his angry stage-whisper.] 'You want this, you like this, so you take care of this!' I would be stuck in the middle. And all those girls turned out to be icons: Kate, Amber, Kristen, all icons."


It makes perfect sense. Does the general public want to know about girls who don't steal each other's boobs backstage and openly throw hissy fits? Of course not. We want to know about the girls who yell and claw at each other over bra inserts. Those are the names we remember. All those models who act professional are doing it wrong. If these girls want to become super again, they should start bringing attitudes to jobs — good, sassy ones — and stealing things.

Last night the Human Rights Campaign of Greater New York held its annual dinner in honor of equal rights for the LGBT community. We caught up with Tim Gunn, who loves his growing legion of straight male fans. Does he think many watch Project Runway? "They do indeed. I'm proud of that, I think it's cool. You can't watch the show and not buy into who the designers are and the whole general nature of what fashion is," he told us. "So the more diverse the audience is, the happier I am. When we were taping in L.A., I had to walk by a construction site to get to the set; my apartment was a block away. At one point, these construction guys were shouting from the scaffolding: 'Tim Gunn, you're killing me with that show!' I bet they're not gay — though I shouldn't say that. You never know. But they were definitely fans."

Tuleh May Be Shutting Down


Tuleh, spring 2010.

Tuleh just canceled its fall 2010 runway show. Now speculation is swirling that the label's funding has run out and it might not survive. WWD reports that Tuleh isn't meeting the demands of its creditors, backed by Trilea Holdings Inc., which are reportedly no longer investing in the label. Trilea is rumored to be looking into options to salvage Tuleh, which could include anything from selling it altogether to forging new licensing deals to getting a loan. A rep from Trilea said, "The business has been and continues to be unprofitable, and creditors were making demands that the company could not satisfy." Insiders told WWD that "the brand still resonates with customers." It remains unclear what will happen to Tuleh's spring deliveries and the label's lower-priced Bryan Bradley line. Fashion Week parties may be back in full force this season, and spirits remain high, but this is just one reminder that the effects of the downturn are still being felt.

Now that the economy has rebounded—for people who make their living on Wall Street, at least!—and big bonuses have returned, how are residents of fancy schmancy Greenwich faring? Life is  "slowly returning to normal," apparently. "The Greenwich version of normal, anyway," which means people are once again turning up to the local Ferrari dealership:

Caterers' cell phones are ringing again. Luxury car dealers are sending the Porsches out for test drives. An architect is booking multimillion-dollar jobs for his "masters of the universe" clients, titans of Wall Street who've made this leafy Connecticut suburb of New York one of the wealthiest towns in the country.
When the financial industry tumbled, Greenwich's fortunes fell with it. Now, as the federal bailout has helped lift investment banks to surprisingly robust profits, the news that major financial firms will dole out billions of dollars in salaries and bonuses this year came as welcome relief here, even though the rest of the country is still grappling with 10 percent unemployment.

Don't think that residents of the tony suburb haven't learned a thing or two from the events of the past year. They have. "Modesty is in, for the first time in a while," says one store owner, who explains that one of his clients recently forced his wife to accept a $90,000 Mercedes S550 sedan this year, instead of her customary Rolls-Royce. And just look at how some homeowners have been forced to scale back, according to the owner of a architecture firm:

In a sign of Greenwich's new restraint, one client chose to build his tennis court on level ground rather than recessing it, which saved about $75,000 in stones, drainage and other construction costs.

A non-recessed tennis court? It's almost too much to bear!

The Huffington Post notes that Anne Hathaway's armpit appears to have been Photoshopped out of her March cover for British GQ. Well, of course it was. The pitness of armpits is always digitally smoothed and removed in magazine photos. But we're more distracted by other things, such as:

1. Why is her armpit the focus of this cover more so than her face to begin with? Or even cleavage?
2. The corset's dragging her bosom down.
3. She needs pants.
4. Her hair is covering her eye, which means we only have half a window to her soul. Surely that's what the profile aims to expose.

For decades, I’ve been searching for the perfect early morning pick-me-up rap song to cause me to feel like a champion til well after the sun sets. Drinking Chivas Regal at 7 am just doesn’t have the same bling to it (kill me) when it’s set to “Jagged Little Pill.”

So thank you, Superbowl XLIV, for giving us the following mash-up, which will serve as a nice replacement to our former Prince-Akeemesque live chamber orchestra alarm clock. It’s Jay-Z & Rihanna meets the CBS NFL theme song (performed by the delicious sounding Posthumus Zone.) It makes me want to make a floor-length fur out of the Puppy Bowlers (separate show, about puppies bowling), and march up and down these city streets for hours on end.

1. All Honda ads should all begin with the disclaimer “Please Flip to the Puppy Bowl for 30 Seconds”

2. As much as we all love to rip on him, Brett Favre isn’t the only player capable of throwing crippling fourth-quarter interceptions.

3. Married men live a castrated, ghostlike existence of torturous apathy, but at least they have Dodge Chargers / Budweiser / Last Airbender trailers!!!

4. Sean Payton’s testicles boast a circumference five times that of the normal man’s.

5. I incorrectly predicted the outcome of the game, was way off on the score, called the wrong MVP, and generally nothing that I said would happen happened.

6. I was 3-for-4 on The Who’s setlist, so we’ll call my day of predicting a wash.

7. We shouldn’t hold lengthy debates about pro-life commercials until they actually air (my bad). Frankly, I’m now a lot more concerned with Tim Tebow’s beliefs about mom-blindsiding.

8. My “Who are they!” chant didn’t catch on.

9. The NFL correctly decided to scrap their original idea for a Super Bowl MVP prize, a Cadillac with a MANNING vanity license plate featuring his and hers monogrammed MANNING towels in the backseat and a giant “Congratulations Manning!” banner sticking out of the Manningroof (a custom Manning-shaped sunroof).

10. We don’t know Sun Life Financial yet, but WE WILL, MOTHERF***ERS. Sleep with one eye open.

11. Fans and betters alike put way too much stock into the last game the Saints and Colts each played, ignoring the rest of the Saints’ season as a whole. We look forward to completely forgetting we did this and being wrong again next year.

12. CBS couldn’t find Kim Kardashian in the stands.

13. Doritos has cornered the dudes-hit-in-the-nuts demographic.

14. New Orleans is apparently totally fine now. Whew! Thank God for that interception.

15. Seriously, guys, aren’t women d*cks???
