Judge Rejects H-1B Visa Injunction

theodp writes "Judge Faith Hochberg has denied a preliminary injunction sought by the Programmers Guild to put a hold on a controversial 'emergency' rule change by the Department of Homeland Security to permit foreign students to work continuously in the US for two-and-a-half years after graduation without an H-1B visa. Hochberg indicated she failed to see how an increased labor supply could result in wage depression for engineers and computer workers. That seems disingenuous, since in Andaya v. Citizens Mortgage Corporation, Judge Hochberg recently saw first-hand how a US employer got away with paying an H-1B computer engineer as little as $15,000 to do a job with a 'prevailing wage rate' of $41,000. In that case, Hochberg ruled against Filipino H-1B visa holder Almira Andaya, arguing that 'nonpayment of wages as listed on the H-1B visa petition ... does not raise a substantial question of federal law.'"

How Important Is Protecting Streaming Media?

spaj writes "In the ongoing battle with the MPAA and RIAA, there seems to be an ongoing argument about who is to blame. If you leave a $20 bill on the sidewalk, can you report it stolen when someone takes it? Of course you can, but will you be taken seriously by the authorities? When my car was broken into, I was told by the responding police officer that I might have prevented it by keeping my seats and visible areas clear of junk that would entice criminals. So, who is at fault when it comes to users abusing their right to capture streaming media for personal use? According to Applian.com's Legal FAQ, the RIAA will not come after you if you make a recording for your own personal use. I have often been torn on this issue, and I am looking for input. Adobe recently released a new format of their widely used streaming protocol, RTMP, that includes 128-bit encryption (RTMPE). I can only interpret this as an attempt to prevent capturing of the streaming media content for personal use. However, Applian has already circumvented the RTMPE protection, and you can read about it on Adobe's forums, where some users seem quite dissatisfied that their content is not protected enough by Adobe's technology. I think the main question boils down to: Who is to blame? Can you blame Adobe for not making a better encryption? Or do you blame Applian for bypassing such security features? Or do you blame the authors of stolen content for leaving the security of their material in somebody else's hands?"

It's great news that young people are getting exposed to SF at an impressionable age, without apparently feeling any particular stigma about it. And yes, a lot of those people will eventually come to view SF as "kid stuff" and stop reading when they reach adulthood. But if even 20 percent of those readers keep reading SF after they turn 18, that guarantees a sizeable readership for SF in decades to come.

The other great thing about YA science fiction is that people come to writing it from all sorts of angles. Some YA authors write non-speculative YA books and then drift into writing books with science-fictional plots.

What I'm trying to say is that labeling novels YA in the hope that that will make them "mainstream" may actually backfire. You will certainly alienate possible adult readers, who feel vaguely nasty for cozying up with a genre aimed at teens. And I believe in the end you will lose teen readers, who are exactly the sorts of people who dislike being told that their youth bars them from understanding adult novels. What self-respecting 15-year-old wants to read "young adult" fiction when she could be reading stuff actually written for adults?

The beauty of science fiction is that our hypothetical 15-year-old can read adult fiction and enjoy it just as much as adults do. Not because scifi is simplistic, but because it usually operates on multiple levels: One level is devoted to an adventurous plot, and the other seethes with social subtext and commentary. The most successful scifi novels should work as entertainment for people of any age, and can suggest deeper ideas to people who have been on Earth long enough to want a little contemplation with their space battles.

Stolen pants, pooped-on veterinarians, fur on fire, foretold seizures, and much more! This book was entirely written by the anonymous crowd. All stories and illustrations were submitted by workers on Amazon's Mechanical Turk. I selected, edited and laid out the stories in a short but sweet coffee table book. The idea for this book was born in Terminal A at Washington Dulles, where I was stranded for some hours in late July. To spend my time, I posted the following two tasks on MTurk: 1) Write at least one paragraph about a funny, unbelievable or otherwise memorable incident involving your cat. 2) Sketch a cat. With or without an environment and toys. Before I got out of that terminal, it was already clear that the submissions were too good to keep to myself."

When we first received our cat, my father brought her home in his car. She was only a kitten and was running around his car like crazy. To keep her from getting lost he put her into the glove compartment. After about fifteen minutes he began to hear meowing from behind the dashboard. He reopened the glove compartment to find the cat had chewed through the plastic. He later had to remove the radio in order to get her out. The look on his face was priceless after the event. This was an omen of times to come with our new kitten.

Lego Tableaus Re-Create Classic Photos

Lego fanboy and amateur photographer Mike Stimpson found a way to combine his two loves: He recreates scenes from historic photographs using the plastic bricks, then snaps his own photos.

The British videogame programmer first began assembling his Lego duplications in October 2007 as a way to pay homage to his favorite lensers: French street photographer Henri Cartier-Bresson, World War II-era shooter Robert Capa, American landscape photographer Ansel Adams.

Stimpson, 34, has used Lego bricks to duplicate everything from Buzz Aldrin's first steps on the moon to '60s antiwar protesters, but he has yet to produce a plastic version of an Ansel image. "Recreating large sections of Yosemite National Park is a little beyond my skills," he said.

To stock up for the shoot, Stimpson says he bought more than 30 Lego minifigures to ensure he'd have enough variety to imitate the men in Ebbets' photo.

Recreating Ian Bradshaw's famous 1974 photograph of streaker Michael O'Brien during a rugby match wasn't easy for Stimpson, who struggled with figuring out how to undress the stock figurine.

"He's actually made up of a yellow Lego spaceman with his body on backwards so you can't see the space insignia," Stimpson said. It's one of the few recreations without a smiling mug: "I tried, but he looked too much like a woman. The face I chose seemed to fit with the 'Jesus' look of the original."

Stimpson cites Behind the Gare Saint-Lazare, the celebrated 1932 image by French street photographer Henri Cartier-Bresson, as one of his favorites. For this blocky recreation of Cartier-Bresson's legendary snapshot of a man leaping over a puddle behind a train station, Stimpson tied a Lego figurine to a piece of thread and suspended it above a baking tray that held a few millimeters of water.

Although Stimpson Photoshopped the string out, the reflection is real -- he used a foam board to help reflect the Lego man in the light. "It took a long time to get all of the elements to work together," said Stimpson. "[There was] a lot of scenery that really liked to float away!"

War photographer Robert Capa became famous in 1936 for his image of a soldier collapsing after a fatal gunshot during the Spanish Civil War. Stimpson used towels and jumpers to create the backdrop of the photograph, then added a Lego character to mimic the dying militiaman.

Although nowadays Lego manufactures plastic characters with a range of facial expressions, Stimpson elected to use one with a simple smile to offset the severity of the original image. "It's a similar effect to [the] Lego versions of Darth Vader or the stormtroopers," he said. "Taking something serious and menacing, and replacing that with something cute, harmless and funny."

Stimpson special-ordered a miniature Lego firearm to complete this blocky rendition of a Pulitzer Prize-winning picture by Associated Press photographer Eddie Adams.

At first, Stimpson wasn't sure how to represent the graveness captured in the 1968 image -- which shows a Viet Cong prisoner being executed -- but in the end he arranged a Lego-ized U.S. soldier and civilian on a Lego roadway and took the shot.

"Some people find it funny," said Stimpson. "Some people find it a bit disturbing."

Stimpson subbed Lego figurines of an airline pilot and a nurse to stage Alfred Eisenstaedt's celebrated image of an American soldier dipping a young woman into a kiss in New York's Times Square in 1945.

"This was a difficult one," said Stimpson. "Lego don't make sailor figures as far as I can tell."

Stimpson made a few modifications for this version of an iconic 1967 image showing a hippie holding a flower out to a line of armed soldiers.

The original was taken by French photographer Marc Riboud at a Vietnam War protest in Washington, D.C. Stimpson swapped the antiwar activist in the image for Star Wars hero Han Solo, then used Imperial stormtroopers for his creation, dubbed Anti-Empire Protest.

"My normal working practice if something doesn't work is to add more Lego stormtroopers," he said. "I think it worked."

After requests flooded Stimpson's inbox asking for a toy edition of Raising the Flag on Iwo Jima, the historic 1945 image by Joe Rosenthal, he knew he had to recreate it.

He hung a white sheet for the backdrop, gathered rocks and pebbles for the landscape and had custom figures made by BrickArms, a company that specializes in Lego weaponry.

Stimpson even carefully printed an American flag for the Marines to plant, but forgot one detail -- the correct number of stars. "I'm English," he admitted sheepishly. "That's my excuse."

How did Stimpson reproduce American journalist Malcolm Brown's 1963 shot of Thick Quang Duc's self-immolation to protest the persecution of Buddhists in Vietnam? With an oilcan, Lego fire purchased on eBay and X-wing pilot Legos wearing red Imperial Guard capes.

"It took weeks to find all those Lego flames," said Stimpson. "I was going to set a Lego figure on fire for this, but I couldn't bring myself to destroy Lego."

Stimpson stuck with his decision to keep facial expressions consistent among his photographs, and said he thinks the soft smile on the burning monk's face reflects inner peace attained through Buddhism.

The reenactment of a 1969 photograph of U.S. astronaut Buzz Aldrin walking on the moon didn't require much -- just a base plate of Lego turf, a sheet of black paper to resemble space and a Lego astronaut.

"Unfortunately, my '80s 'classic' spacemen were a bit too broken and chewed to use for that shot," Stimpson said. He hunted down a space-suited figure from a set, although he worried it looked too modern.

Although Stimpson says he has more Lego sets and parts than he can count, he often mixes and matches parts to get the right look. The biggest challenge is finding proper Lego-ized attire for the figures in his recreations, he said.

Openmoko released an update to their software stack earlier this month, called Om2008.8, which is still a work in progress. But now one can use these instructions on the Debian wiki to open up the possibility of using apt-get to access Debian's more than 20,000 applications on your phone, which, due to integration with freesmartphone.org efforts, can also actually be used as a phone. There were previous efforts to run Debian on the predecessor product to the Neo FreeRunner, the Neo 1973, but with the wider adoption of the Neo FreeRunner and the hard work of many Debian developers at the ongoing DebConf 8, carrying Debian in your pocket has just gotten a lot easier."

Remember the story about the pit bull cloner who is suspected by many of being the same woman who kidnapped a Mormon missionary 30 years ago to be her sex slave? Well, she is now suspected of plotting a burglary in Tennessee to procure funds for an artificial horse leg.
Joyce Bernann McKinney, a former beauty queen who earlier this year paid £25,000 to have her dead pet recreated, is accused of instructing a 15-year-old boy to break into a house because she needed funds to help another beloved animal, her three-legged horse.

The Tennessee charges stem from McKinney's arrest in November 2004 after being found in a van with the teenager. According to prosecutors in Carter County, an area in north eastern Tennessee, she instructed the boy to burgle a house and was charged with criminal conspiracy to commit aggravated burglary and contributing to the delinquency of a minor.

Heinz-Jürgen Ehrig, a German Science Fiction fan, has collected about 130.000 Science Fiction books, magazines, fanzines, etc. Since his death in 2003, his widow, the SciFi author Marianne Sydow has spend gazillions of hours cataloguing his collection and is now publishing the bibliographical data on a monthly basis in a paperback + CD outfit for a small fee. Unfortunately she finds it hard to get any subscribers, which is a shame really. It would be a shame if this project dies. Researchers at the Nanoscale Science and Engineering Center (NSEC) at the University of Wisconsin — Madison have come up with a method that uses existing technology to combine the lithography techniques traditionally used to pattern microelectronics with novel self-assembling materials known as block copolymers, researchers said. The US Swim Team's Secret Weapon, Science

Hugh Pickens writes "When American Swimmer Margaret Hoelzer goes for the gold tonight in the 200-meter backstroke, part of her success will be due to a new system developed by Tim Wei, a mechanical and aerospace engineer at Rensselaer Polytechnic Institute, that uses fluid dynamics to study human movement allowing scientists and coaches to study how fast and hard a swimmer pushes the water as he moves through it. 'Wei uses a tracking technique called digital particle image velocimetry, commonly used to measure the flow of small particles around an airplane or small fish or crustaceans in water.' Wei filtered compressed air in a scuba tank through a porous hose to create bubbles about a tenth of a millimeter in diameter. When an athlete swims through a sheet of bubbles that rises from the pool floor, a camera captures their flow around the swimmer's body and the images show the direction and speed of the bubbles, which Wei then translates into the swimmer's thrust using software that he wrote."

Shockingly, the press conference (shown live on CNN!) where two Bigfoot "hunters" and one Bigfoot "researcher" were to reveal proof that they have a dead Sasquatch in a freezer was a bust. From FOXNews:

Scientists Use Algae To Measure Water Pollution

Researchers in Israel have discovered a new technique to determine water pollution levels by listening to sound waves produced by tiny pieces of floating algae.The sound waves can be used to identify the type and amounts of contamination in the water."It is a red light, telling us that something is beginning to go wrong with the quality of water," Zvy Dubinsky, an aquatic biologist at Bar Ilan University in Israel, told Reuters.
