RIAA Wants To Throw In the Towel On 3-Year-Old Case

NewYorkCountryLawyer writes "After three years of pursuing a home health aide in Brooklyn who has never even used a computer, the RIAA has announced it's ready to throw in the towel. Only thing; it wants the dismissal to be 'without prejudice' so it won't be liable for attorney's fees. The courts have been saying that where a copyright plaintiff gives up, the defendant is presumptively entitled to an attorney's fee award. So, Ms. Lindor says 'no way.' She wants the dismissal to be 'with prejudice,' and she wants her attorney's fees." We've been discussing this case and Ms. Lindor's fight against the RIAA for quite some time.

NotNormallyNormal writes "CBC picked up an AP story about ICANN recently losing control over two of their domain names on Thursday, June 26. A domain registrar run by the group transferred the domains to someone else. ICANN's press release had this to say: 'As has been widely reported, a number of domain names, including icann.com and iana.com were recently redirected to different DNS servers, allowing a group to provide visitors to those domains with their own website. It would appear the attack was sophisticated, combining both social and technological techniques, but was also limited and focused.' Comcast has had similar troubles lately as well."

Cassini's Primary Mission Ends, Two-Year Extension Begins

wooferhound points out recent news that the Cassini probe has completed its original four-year mission and is beginning a two-year extended mission, which was authorized earlier this year. Cassini's first mission brought us a treasure trove of information about Saturn and its various moons. The new mission will target two of those moons in particular for further study: Titan and Enceladus. Quoting: "The spacecraft is extremely healthy and carries 12 instruments powered by three radioisotope thermoelectric generators. Data from Cassini's nominal and extended missions could lay the groundwork for possible future missions to Saturn, Titan or Enceladus. [The two moons] are primary targets in the two-year extended mission, dubbed the Cassini Equinox Mission. This time period also will allow for monitoring seasonal effects on Titan and Saturn, exploring new places within Saturn's magnetosphere, and observing the unique ring geometry of the Saturn equinox in August of 2009 when sunlight will pass directly through the plane of the rings."

Where the Linear Crosses the Exponential: Kevin Kelly


Snip from an essay published by Kevin Kelly today over on his Technium blog:

All extropic  systems -- economy, nature and technology -- are governed by self-accelerating feedback cycles. Like compounding interest, or virtuous circles, they are powered by increasing returns. Success breeds success. There is a long tail of incremental build up and then as they keep doubling every cycle, they explode out of invisibility into significance. Extropic systems can also collapse in the same self-accelerating way, one subtraction triggering many other subtractions, so in a vicious cycle the whole system implodes. Our view of the future is warped and blinded by these exponential curves.

But while progress runs on exponential curves, our individual lives proceed in a linear fashion. We live day by day by day. While we might think time flies as we age, it really trickles out steadily. Today will always be more valuable than some day in the future, in large part because we have no guarantee we'll get that extra day. Ditto for civilizations. In linear time, the future is a loss. But because human minds and societies can improve things over time, and compound that improvement in virtuous circles, the future in this dimension is a gain. Therefore long-term thinking entails the confluence of the linear and the exponential. The linear march of our time intersects the cascading rise and fall of numerous self-amplifying exponential forces. Generations, too, proceed in a linear sequence. They advance steadily one after another while pushed by the compounding cycles of exponential change.

Balancing that point where the linear crosses the exponential is what long-term thinking should be about.

Iran: death penalty for “corrupt weblogs”


New legislation has been proposed in Iran that could make blogging a crime punishable by death. Cyrus Farivar has a story on today's edition of the PRI radio show The World: Iran considers harsh penalty for some bloggers (3:30).

Over at Global Voices, Hamid Tehrani writes:

On Wednesday, Iranian members of parliament voted to discuss a draft bill that seeks to “toughen punishment for disturbing mental security in society.” The text of the bill would add, “establishing websites and weblogs promoting corruption, prostitution and apostasy,” to the list of crimes punishable by death.

In recent years, some Iranian bloggers have been sent to jail and many have had their sites filtered. If the Iranian parliament approves this draft bill, bloggers fear they could be legally executed as criminals. No one has defined what it means to “disturb mental security in society”.

Such discussion concerning blogs has not been unique to Iran. It shows that many authorities do not only wish to filter blogs, but also to eliminate bloggers!

Whoever stole it is a total douche, and deserves a special place in hell where screaming emo demons torture them with burns from a thousand clove cigarettes, poke them with a million blunt eyeliner applicators, and blind their eyes with painfully asymmetrical hair extensions for all eternity.

The grave marker, wherever it is now, reads: "Ian Curtis 18 - 5 - 80" and the words "Love Will Tear Us Apart".

Working Towards an Eco-Friendly Fireworks Display

The ACS's Chemical and Engineering News provides a fairly technical discussion about the hazardous chemicals in modern fireworks displays. Perchlorate is currently the oxidizer of choice in fireworks, but it is also known to be a thyroid blocker. Since perchlorates are water-soluble anions, they dissolve into groundwater quickly. A study performed last summer over a lake in Ada, Oklahoma showed that less than a day after a fireworks display, the lake's chlorate levels jumped by a factor of 1,000. It took weeks for the levels to drop back down to their baseline. On the other hand, heavy metals are used to produce the pretty colors typically associated with the best fireworks. The trend is to start using nitrogen-based oxidizing fireworks; they produce less smoke, which means a smaller amount of colorizing agents can be used in displays."

Terrible new Brazilian Internet law proposal will criminalize brazillions of people

Pedro sez, "Brazil is about to pass possibly the strictest legislation ever regulating the internet. The bill will be voted in the next few days by the Brazilian Senate. Please see below the translation of the article published today by Folha de Sao Paulo, the largest newspaper in the country:"
According to Ronaldo Lemos, by referring to "computer networks", "communication devices" and "information systems", the draft law covers not only computers, but also MP3 players, cell phones, DVD players, software systems and even digital TV set-top boxes, not to mention websites. Following this line of reasoning, the bill would cover even the act of unblocking a cell phone.

The professors claim that no country criminalizes access to information on the Internet in such broad fashion. "The closest legislation to what is being proposed here is the one passed in the USA, which criminalizes the act of circumventing technological protection measures. But no law has criminalized access itself," mentions the brief.

Article 285-B qualifies as a crime – also punished with 1 to 3 years of imprisonment and a fine – "to obtain or transfer data or information" without prior authorization of the legitimate owner.

The professors propose the exclusion or amendment of the text of two articles of the draft law. They suggest that the access and transference of information on the Internet be considered a crime only if fraud or "unlawful advantages" are involved.

Interview With Author of the First Spoof Language

An anonymous reader brings us Computerworld's interview with Don Woods, one of the creators of Compiler Language With No Pronounceable Acronym (INTERCAL). INTERCAL and its documentation were created in 1972 as a parody of that era's languages and instruction manuals. Among other things, Woods had this to say: "We designed the language without too much trouble. Writing the manual took a while, especially for things like the circuit diagrams we included as nonsensical illustrations. The compiler itself actually wasn't too much trouble, given that we weren't at all concerned with optimising the performance of either the compiler or the compiled code. I admit I'm surprised at its longevity. Some of the jokes in the original work feel rather dated at this point. It helps that the language provides a place where people can discuss oddball features missing from other languages, such as the 'COME FROM' statement and operators that work in base 3."

NC Judge Takes "A Fresh Look" At RIAA Subpoenas

NewYorkCountryLawyer writes "When some North Carolina State students recently brought to the attention of the Court the apparent illegality of the RIAA's investigations by unlicensed investigators, they also caught the attention of the judges. After reading these new papers, District Judge Louise W. Flanagan, who admits that she's been routinely signing the RIAA's ex parte discovery orders in the past, has indicated that she is now going to take 'a fresh look' at the RIAA's tactics. She issued a stay of the subpoena, ordering NC State not to respond to it, and referred the motions to dismiss the cases to a Magistrate Judge for him to take that 'fresh look' at what has been going on."

Open Source Twitter Competitor Emerges

ruphus13 writes "Twitter has had a lot of public woes with Open Source technologies like Ruby on Rails, and a lot of alternatives have sprung up in the micro-blogging world, but no one has managed to dislodge twitter in its usage or appeal. Now, an Open Source alternative by Identi.ca, backed by project Laconica has emerged. From the article, 'It supports OpenID for logins, is completely free software, and is designed to apply a Creative Commons license to all the traffic that it carries. It's also built to support the OpenMicroBlogging protocol, meaning that (at least in theory) it can attack scalability issues by federating together multiple autonomous servers. The underpinnings of Laconica include PHP, PEAR, and XMPP. You can download a tarball of the source, or check it out directly if you're using Darcs (there's also an unofficial mirror on Google Code, giving you Subversion access for a read-only copy).' The community will still need to work on this, if a true competitor to twitter is to be had. It is lacking APIs, and SMS integration. Oh, and millions of users!"

The reels have been authenticated by the Murnau foundation at Germany. 'Although estimates of its original length vary depending on the speed at which it is shown, Possmann said "Metropolis" was conceived as a film lasting just over 2-1/2 hours. Around 20 to 25 minutes of footage that fleshes out secondary characters and sheds light on the plot would be added to the film pending restoration, he added. But around 5 minutes of the original were probably still missing, he said.'"

They’re about the human body as a decomposing corpse – the art of a rotting cadaver. It’s also a tribute to horror movies, which I love.

What influenced your tattoos? When I was a kid I was a big fan of the Teenage Mutant Ninja Turtles, and I wanted to be a ninja turtle and live in the sewers. But as I got older I fell in love with zombies and wanted to become one. Oh, and I love George A Romero’s Living Dead movies.

Anyway, the closest thing I could get to becoming a zombie was to get tattooed like one.
